The Laws in The Censuses and the 1845 Highway Tax Record

The census was taken every ten years in England. The first census of genealogical interest was taken in 1841.

The highway tax record for 1845 listed the widow and several of the children of Benjamin Law.


1841 Census

There were ten Law "families" listed in Batley and New Batley in the 1841 census out of a total population of 7,076.

In this census, the ages of every one over fifteen years were rounded to a multiple of five.

  1. George Law, the son of Benjamin and Rachael Stubley was listed in Enumeration District 6, Havercroft, Batley

    • George Law, Rag Dealer, age 50
    • Sarah Law, age 50
    • Thomas Law, cordwainer, age 15
    • William Spurr, age 9.

    Notes:

    • George's first wife was Martha Hall. Martha must have died and George remarried.
    • Thomas was born in 1824 and was really 17 year old.
    • I do not know who William Spurr was. Joseph Law married Sarah Spurr in Batley parish on May 20, 1821. However, Joseph Law and George Law where at best distant cousins.
    • George was listed in the 1851 and 1861 census, see below.

  2. William, the son of Benjamin Law, by his marriage to Lydia Sheard was listed in Enumeration District 7, Havercroft, New Batley

    Note:

    • I do not know who Hannah Law was. Later censuses indicate that she was born circa 1809 and that she was single. She was listed on the page after William Law. Benjamin had a daughter, Hannah, baptized in 1805. However, I believe that that Hannah married in 1825.

    Note:

    • Esther was the daughter of Joseph Law and Sarah Spurr baptized on May 18, 1823 in Batley. Joseph Law married Sarah Spurr, May 20, 1821.
    • Joseph Law was the son of John Law and Mary Bentley and a descendant of James Law hatter. He appears to be the only member of that branch to have remained in Batley. The family was originally from Birstall parish, where they shared a common ancestor with the other Laws in Batley in James Law and Alice Rawse of Gomersal .
    • Ester was listed in the 1851 and 1861 censuses with her parents.
  9. John Law, woolen weaver, age 20, with Benjamin Fox, age 25, Lydia Fox, age 20, John Fox, age 4, and Joseph Fox, age 1.
  10. Joseph born Birstall circa 1819, was listed in 1841 in Batley and in 1851 in Gomersall. In the 1851 censues he listed his birth place as Birstall.
I did not find Lydia Law listed in the 1841 census. She was still alive. She died in 1849. She was listed in the 1845 highway tax list, see below.

There were ten Law households in Batley the 1851 census.

    The 1851 census from Batley, as are all censuses, is divided into enumeration districts. A section of the city, county or town is predetermined and the census taker goes to all the house-holds in that designated area or "enumeration district" and interviews a representative from each family in that district and asks the questions that have been selected for that particular census. This is a description of the enumeration district of Batley in which William Law and family lived in 1851:

    " All that part of the township of Batley situate (sic) at Providence Street New Batley and Batley bounded on the East by Providence Street on the South by the road leading from thence to New Batley on the West by the road leading through New Batley and the North by the road leading from thence to the North end of Providence Street. Houses 97."

George was the son of Benjamin Law and his first wife, Rachel Stubley, William, Joseph, and Isaac were the sons of Benjamin and Lydia, and John Law was the son of Benjamin's son, George. Hannah Law was listed as an unmarried head of house hold born in Birstall. She may have been married to a Law. The household of Thomas Simpson included several Law children born in Birstal (I am not listing them here because I do not believe that they are closely related to my family of Laws.).

There was also a listing in Havercroft, for the family of Charles Stubley, the "bastard of Rachael Stubley:

    Charles was Rachael Stubley Law's "bastard". I believe that he was also the son of Benjamin Law, since Benjamin married Rachael when Charles was only a few months old.

Joseph and Jeremiah the sons of George Law and Martha Hall were listed at Flatt Land Spinkwell in Dewsbury as follows:

The 1861 Census

The 1861 census was taken between March 31 and April 8th.

There were 16 Laws or related family in the 1861 census in Batley. There were twenty Enumeration Districts in Batley in the 1861 census. Laws were listed in EDs 1, 8, 9,10, 11, 12, 13, 17, 19 and 10.

The 1861 census in Batley included among other relations:

  • William Law, the son of Benjamin and Lydia.
  • John Land who married William Law's daughter, Lydia
  • George, the son of Benjamin and Rachael Law
  • Joseph, Isaac, and Abraham, the sons of Benjamin and Lydia
In addition, there were several Laws born in Batley who I haven't yet identified.

There were also two Laws who were not born in Batley. I have not including them in the list below.

Marie Law was not listed in the 1881 census in Batley.

    The 1881 census index shows only one other person with the surname, Law, born in Batley. Samuel Law, age 40, born in Batley, his wife, Nancy, and their three children were listed in Thornhill, Yorkshire. At this point, I do not know for sure who Samuel Law was. However, it is highly likely that he was the son of Joseph Law, quarryman, born in Birstall and listed in the 1861 census in Batley. Samuel was also listed in Thornhill in the 1871 census.
